So, how does it work? Well, if you’re owed money under a court order, you can apply to the Magistrates Court for an enforcement hearing. These hearings reveal financial information about the debtor who owes you money. Once the hearing is set, the debtor must fill out a statement regarding their finances, which gives the creditor information about the other party’s ability to pay the money they owe. The creditor can then launch enforcement proceedings within six years of the money order being made.
It can be very challenging for a creditor to learn about the amount of capital their debtor has at their disposal when they have refused to pay their debt. That’s where we come in. An enforcement warrant is used to enforce money owed by a debtor to be paid to a creditor in court. Oftentimes—even after winning a civil case and being credited to receive a court ordered payment—debtors will still refuse to pay up to the creditor.
